1 – Acceptance of these Terms
By accessing or using SpotMyCharge.com (the “Website”) you agree to be bound by these Terms of Service (“Terms”). If you do not accept every provision below, do not use the Website.

2 – Nature of the service
SpotMyCharge.com is an online directory of electric-vehicle (EV) charging points, fuel / gas stations, service areas and related amenities. We are not an energy supplier, fuel retailer, charging-network operator or logistics broker. We simply present information so that users may research and contact station operators on their own initiative.

3 – No operational advice or endorsement
All content is supplied for general information only and must never replace due diligence with the station operator. We do not guarantee the accuracy, completeness, pricing, real-time availability, safety compliance or service quality of any listed station and we do not endorse any specific operator, connector type or fuel brand. Choosing where and how to charge or refuel remains entirely your own decision and responsibility.

4 – Eligibility and user obligations
You must be at least 18 years old and legally able to enter contracts. You agree to provide truthful, current information in all forms and to refrain from:

• submitting false or misleading enquiries/lifetime-listing requests
• scraping or copying large portions of the directory without permission
• introducing malware, carrying out denial-of-service attacks or otherwise disrupting the Website
• uploading or transmitting content that is defamatory, obscene, infringing or unlawful

We may suspend or delete enquiries we reasonably believe to be fraudulent or abusive.

5 – Station listings and ownership of data
Each station owner retains ownership of its own profile data, trademarks and images. Owners may request modification or removal of a listing at any time by e-mailing contact@spotmycharge.com; we will comply within a reasonable period. By submitting text, photos or other materials to us, a station owner warrants that it has the right to do so and grants us a non-exclusive, worldwide, royalty-free licence to display such materials on the Website.

6 – Intellectual property of the Website
All layout, graphics, software, texts and compilations created by us are our property or used under licence. They may not be reproduced, distributed or adapted without our prior written consent except as permitted by law.

7 – Third-party content and links
The Website may contain links to external sites we do not control. We are not responsible for the content or privacy practices of those sites. Accessing them is at your own risk.

8 – Disclaimer of warranties
The Website is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy or uninterrupted availability. Some jurisdictions do not allow exclusion of implied warranties; where prohibited, such exclusions apply only to the extent permitted by law.

9 – Limitation of liability
To the fullest extent permitted by law, SpotMyCharge.com and its officers, employees and agents will not be liable for any indirect, incidental, consequential, special or punitive damages, or for any loss of profits, data or goodwill, arising out of or in connection with: your use of or inability to use the Website, any communication or transaction between you and a station operator, and any reliance on information displayed on the Website.

10 – Indemnification
You agree to defend, indemnify and hold harmless SpotMyCharge.com from any claim, loss, damage, liability or expense (including reasonable attorneys’ fees) arising from your violation of these Terms or misuse of the Website.

11 – Governing law and jurisdiction
These Terms are governed by the laws of Hong Kong, SAR China without regard to conflict-of-laws principles. Any dispute that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the United States District Court for the Northern District of California, unless mandatory consumer-protection rules provide otherwise.

12 – Privacy Policy
Your use of the Website is also governed by our Privacy Policy, available at https://www.spotmycharge.com/privacy. By continuing to use the Website you confirm that you have read and understood that policy.

13 – Modifications to these Terms
We may revise these Terms at any time. The revision date at the top of this page will change accordingly. Your continued use of the Website after a revision constitutes acceptance of the updated Terms.
